The Difference Between Major Wala & Minor Wala

بسم الله
The Difference Between the Division of Wala (friendship/alliance) which Takes One Out from the Fold of Islam and the Division of Wala which Does Not Take One Out from the Fold of Islam

Bismillahirrahmanirrahim,

Allah Taala stated:


يَا أَيُّهَا الَّذِينَ آمَنُواْ لاَ تَتَّخِذُواْ الْيَهُودَ وَالنَّصَارَى أَوْلِيَاء بَعْضُهُمْ أَوْلِيَاء بَعْضٍ وَمَن يَتَوَلَّهُم مِّنكُمْ فَإِنَّهُ مِنْهُمْ إِنَّ اللّهَ لاَ يَهْدِي الْقَوْمَ الظَّالِمِينَ

O ye who believe! Take not the Jews and the Christians for your friends and protectors: They are but friends and protectors to each other. And he amongst you that turns to them (for friendship) is of them. Verily Allah guideth not a people unjust. (al-Maidah 5/51)

The major Wala which takes one out from the fold of Islam is; engaging in the rows of the Kuffar, being adherents to them and showing compliance to their Kufr. With regards to this issue Imam Ibn Jarir at-Tabari (rahimahullah) said the following while giving information about the Ayah, al-Maidah 5/51:


فإن من تولاهم ونصرَهم على المؤمنين، فهو من أهل دينهم وملتهم، فإنه لا يتولى متولً أحدًا إلا وهو به وبدينه وما هو عليه راضٍ. وإذا رضيه ورضي دينَه، فقد عادى ما خالفه وسَخِطه، وصار حكُمه حُكمَه

And he amongst you that turns to them (for friendship) is of them that Allah meant; whosoever takes the Jews and Christians as allies instead of Muminin (the believers) is from them meaning anyone who takes them as Awliya (friends/allies) against Muminin is from their Din and Millah, because no one takes anyone as a protector except that he is pleased with and his faith. And if so, such a person will show enmity towards anything that conflicts with the faith that he is loyal to, and therefore the same verdict of disbelief is applicable to both. (Tabari, Tafsir)

As seen, the base of Wala is bounded with consent. Even though this action is not Jaiz (permissible), one can not be made Takfir of, if his Wala towards the Kuffar merely occurs as a worldly relation and does not reach consenting with their Din.

For this reason when Hatib ibn Baltaah (radiyallahu anh) declared his excuse by stating:


وَمَا فَعَلْتُ كُفْرًا وَلاَ ارْتِدَادًا وَلاَ رِضًا بِالْكُفْرِ بَعْدَ الإِسْلاَمِ‏

I did this neither because of disbelief not apostasy nor out of preferring Kufr (disbelief) to Islam. (Bukhari, #3007) Even though Rasulullah (sallallahu alayhi wa sallam) condemned him (radiyallahu anh), he (sallallahu alayhi wa sallam) did not make Takfir of him.
Whosoever desires الْعِزَّةَ al-Izzah (honour, power and glory) then to Allah belong all الْعِزَّةَ al-Izzah [and one can get honour, power and glory only by obeying and worshiping Allah (Alone)]. To Him ascend (all) الْكَلِمُ الطَّيِّبُ al-Kalim al-Tayyib (the goodly words), and الْعَمَلُ الصَّالِحُ al-Amal al-Saalih (the righteous deeds) exalt it (the goodly words i.e., the goodly words are not accepted by Allah unless and until they are followed by good deeds). (Fatir 35/10)
